Candidate Personnel Clarification Notice Regarding Personal Data
A) DATA CONTROLLER
DMS Savunma Sanayi ve Otomotiv Tic. A.Ş. (hereinafter referred to as DMS SAVUNMA) is the data controller.
As the Company, we show the highest level of diligence and sensitivity in protecting your personal data, and we attach great importance to the processing and preservation of all kinds of personal data belonging to our prospective employees in accordance with the Law on the Protection of Personal Data No. 6698.
Necessary security measures have been defined to prevent unlawful processing of and access to your personal data, and necessary administrative and technical measures—such as authorization limitations and the signing of confidentiality agreements—have been taken to ensure that employees who have access to this data do not unlawfully disclose it to others or use it outside the scope of processing.
B) METHOD AND LEGAL REASON FOR COLLECTING YOUR PERSONAL DATA
DMS SAVUNMA collects your personal data based on the legal ground of the data controller's legitimate interest. The data collection activity is carried out through the provision of data by you, the candidate personnel, to DMS SAVUNMA, and through verbal or written interviews conducted with individuals listed as references.
Your collected personal data:
Identity Information: Turkish ID Number (TCKN), Passport No, name-surname, signature, photograph, place of birth, date of birth
Contact Information: E-mail, phone number, mobile phone of individuals,
Physical Space Security Information: Entry-exit record information and camera records to be captured in the event that candidate personnel visit the company
Education, Qualification, and Professional Experience Information: Diploma information, courses attended, in-service training information, driver's license details, certificates, transcript information.
Visual and Audio Records Information: Photograph, captured camera records and images.
Criminal Conviction and Security Measures Information: Criminal record, criminal conviction, or security measure information contained in the judicial registry record for recruitment purposes.
C) PURPOSE FOR WHICH PERSONAL DATA WILL BE PROCESSED
DMS SAVUNMA processes your personal data mentioned above for the purposes of:
Verifying your identity information and documents;
Conducting a preliminary evaluation about you for the job subject to candidacy;
Ensuring the necessary coordination in job interviews to be conducted with you;
Meeting potential personnel needs that may arise in the future in the event that the job interview concludes negatively;
Job, salary determination, and offers;
Obtaining opinions and confirmations from your previous employers;
based on the legal ground of the data controller's legitimate interest.
Your personal data will be retained and destroyed by us under high-security measures together with the technical and administrative security measures we have established, in accordance with the LPPD and the Regulation on the Deletion, Destruction or Anonymization of Personal Data, for the periods determined and mandated by the relevant laws.
In the event that the purpose of processing personal data ends and the periods specified in the laws expire, personal data are retained solely for the purpose of serving as evidence in potential legal disputes, asserting a right dependent on the stored data, establishing a defense regarding our legal rights, ensuring the statute of limitations has not expired, and/or presenting it upon request by authorized official authorities. All administrative and technical measures, retention and destruction methods taken by us are specified in the DMS SAVUNMA Privacy Policy, which can be accessed at www.dmsgroup.com.tr.
Ç) TO WHOM AND FOR WHAT PURPOSE THE PROCESSED PERSONAL DATA CAN BE TRANSFERRED
DMS SAVUNMA transfers your personal data mentioned above through automated means based on the legal reason of the data controller's legitimate interest, strictly limited to cases where you send your data through channels whose servers are located abroad (Gmail, WhatsApp, etc. communication channels) or request your personal information through these virtual environments, and the server of the communication channel used for transmission is located abroad.
There is a decision of the Personal Data Protection Board dated 31.05.2019 and numbered 2019/157; stating that “In case the G-mail e-mail service infrastructure belonging to the Google company is used, since the sent and received e-mails will be kept in data centers located in various parts of the world, in such a case, personal data will be deemed transferred abroad, and data controllers must carry out the said application in accordance with the provisions of Article 9 of the Personal Data Protection Law No. 6698 (Law) titled 'Transfer of personal data abroad'; and it has been decided that storage services obtained from data controllers/data processors whose 'servers' are located abroad must also be carried out in accordance with the provisions of Article 9 of the Law.”
Since this transfer does not take place in line with the choice of the data controller, our company bears no legal responsibility regarding the storage obligations of these foreign-sourced companies.
D) OTHER RIGHTS OF THE DATA SUBJECT LISTED IN ARTICLE 11
Regarding the processing of your personal data as a candidate personnel by DMS SAVUNMA, you have the right to:
• Learn whether your personal data are processed or not,
• Request information if your personal data are processed,
• Learn the purpose of processing personal data and whether they are used appropriately for their purpose,
• Know the third parties to whom personal data are transferred inside or outside the country,
• Request correction of personal data if they are processed incorrectly,
• Request the deletion or destruction of personal data in the event that the reasons requiring the processing of personal data disappear, provided that the legally mandated periods have passed and it does not prejudice the rights of our firm,
• Demand the compensation of the damage in case you suffer damage due to the unlawful processing of personal data.
For the rights in question, by filling out the Personal Data Information Request Form, you may:
Deliver it in writing to our Department,
Send it to our department's address via registered mail with return receipt or through a notary public,
Send it via e-mail to info@dmsgroup.com.tr by signing it with a secure electronic signature and using your registered electronic mail address.
Your requests for information regarding your personal data will be answered as soon as possible and in any case within 30 days at the latest. No fee will be charged if the response regarding the requested information is less than 10 pages; if it exceeds 10 pages, a fee of 5 TL will be charged per exceeding page. In order for third parties to make a request on behalf of personal data subjects, a special power of attorney issued through a notary public by the data subject on behalf of the applicant must be present.
Within this scope, regarding your personal data held;
